IPP prisoner sentence quashed
Georgiana McCarthy of BK law instructing Muin Boase of Great James Street Chambers have successfully represented an IPP prisoner whose indeterminate sentence was quashed last week at Wolverhampton Crown Court after 20 years imprisonment.
The Defendant had committed an offence of arson (being reckless as to whether property would be destroyed) at only 17 years old. He was originally sentenced to Imprisonment for Public Protection with a minimum term of two years and 82 days. At the time of release, he had served 20 years in prison, almost 18 years over his minimum tariff.
Following a referral by the Criminal Cases Review Commission, the Court quashed the original finding of dangerousness and replaced the original IPP sentence with a determinate sentence of four years and 264 days.
The Defendant was released immediately.
